Hi there,


I applied for my PSW visa on jan 30st and my visa was expired on 31st jan which was student visa
1)my application was rejected due to financial grounds
2)I appealed to court trough the lawyer and went to court for hearing in May
3) my appeal was rejected at the court and gave a chance to appeal again
4)then I appealed to the High Court, I recently got the judgement from the court which was again Unsuccessful

Now my lawyer says is that rules have changed
and suggested me to apply freshly for PSW with new application...

can I apply for the PSW now??????

Yes, launch a new application if you meet all the requirements but do it by yourself, don't use a lawyer.
Now considering that your high court appeal was rejected am unsure what catgory of visa you have at the moment.
I am currently going through a high court appeal having a 3C visa and last week just launched a fresh application. Chances are 50 - 50. In my case I enlosed letters from my MP and a high court determination letter advicing AIT reviewing my case.
Find out whether you still have some kind of valid visa before sending a new application.

D29 and D30 in psw application form

do i come under overstayer???
how to fill D29 and D30 in psw application form in my case?/

I don't think you are an overstayer since HO gives 28 days to leave the UK once you last appeal is dismissed. If i were you I'd send a fresh application as you don't have much to lose at this stage. I'd suggest you to get advice of an immigration solicitor asap to launch an application by yourself.
