ILR calculation from the date visa stamped/first entry to uk

Post by hsmphsmp » Tue Sep 22, 2009 9:03 am

Any one know how the ILR caluculation for 5 years made? Does it start from the date the visa was first stamped or from the date first entered UK?

Many Thanks

Date of first entry on qualifying leave.

You clock starts when you visa starts. IF you enter 6 -9 months after visa start date you need to catch up (obviously by getting 2nd extension).

So if you 5 year start whenever you enter ... you always need to catch up with visa start date.

It is from the day you were first present in the UK upon received your HSMP/Tier 1.

If for example, you were on IGS/SEGS and received your Tier 1 on 20/09/2009 from inside the UK, you will be eligible to apply for ILR on 20/09/2014.

If you received your Tier 1 in India on 20/08/2009 and entered the UK for the first time on this Tier 1 visa on 20/09/2009, once again you will be eligible for ILR on 20/09/2014.

In both instances you must not exceed the time spent outside the UK limit.
