Returning to the UK just before the VISA expiry date

Post by kiranthomas » Mon Oct 05, 2009 11:15 pm

I just finished my studies from a UK university and my student VISA expires on Nov 30. I am now going to my home country (India) and I plan to return back a week before my VISA expiry date(Nov 30). I intend to apply for my VISA extension as soon as I return back to the UK.

My question is, will I face any problem at the immigration check at the airport if I return just a few days before the VISA expiry date? Will they send me back to India, stating that I have completed my studies and have got only few days left in my VISA. Technically speaking, everything is perfect on my side. I have maintained £800 for 3 months and all other requirements. Even my university has agreed to provide me a letter stating that I intend to apply for VISA extension as soon as I return back. What do u guys think? Will it be safe on my part to return back at that time? Pls help me out. I am really worried.

Unfortunately, you may be refused entry on your current student visa because you have finished your studies (321A(1)).

Thanks Vinny and Gaurav for your replies. But I forgot to mention an important information. The reason why I am coming back to the UK a week before my VISA expiry date is because of my graduation ceremony. My graduation happens to be on Nov 30 and it is the same date on which my student VISA expires.
Will this be a good reason to justify why I am coming back at the last minute? My university has agreed to give me a letter stating that I am coming back because of the graduation and I also intend to apply for post study work visa soon. Thanks in advance..

If eligible, then it may be better to apply and wait for PSW before departing the UK or apply for PSW in home country before travelling back to the UK.

Remember universities can no longer extend your stay as student to attend the gradation ceremony, you need to leave the UK and come back as a visitor which is something you should know about but not advisable since visitor visa is crap basically.
