Strange Tier1 Visa extension!!!

Strange Tier1 Visa extension!!!

Hi All,

Quite a strange story to begin with.

One of my frds here is on Tier1 since last year. She is the main Applicant and her hubby is dependent. Their Tier 1 will expier on Oct 2011. She is in IT field,do not work here since a year as she wanna be a home maker for some time as she has been working since 10 years in her home country.However, Her Hubby has a good job here in London.

The prob here is of extension. By the time their Tier 1 expires , she will still not be working and she cant apply for the extension. As her hubby is on dep visa, they have to move to their Home country and apply for Tier 1 again with her Hubby as main applicant. Is this scenario possible? If so, what will be the amount of maintenance funds her hubby has to show ? is it 800+533+533 or 2800+1600+1600( 2 dependents)..Will her hubby get 5 points for UK exp?

Her hubby has Master degree recognised by Naric.

Any advices are appreciated.

I am not an expert, but to me it appears they both have to go back after the current visa expiry. Then her husband can apply for a fresh tier-1 application claiming for UK experience, earnings etc.

He can apply for his wife as dependent together, but this might complicate things. Hence best is to come to the UK, wait for 3 months or so and then apply for his wife as a dependent.

May be some experts could correct me.

Yes, it is possible, they have to apply from home country.

Her hubby has Master degree recognised by Naric. If PBS calculator recognizes the degree, then do not need even NARIC. But if it is not there on calculator, then must submit NARIC letter together with application.

Any advices are appreciated.

One needs help of immigration lawyers if the case/circumstances is/are a bit complicated and also when one is not confident of applying for appeal him/herself. Also depends on how risk averse one is and how much faith one has in the solicitors.

You are correct in pointing out that this forum has huge collective wisdom based solely on individual experiences.
