9 weeks gap between Date of Entry and Date of EC

Hi

I got my EC for HSMP for two years - 31 January 2007 - 31 January 2009. (Application made before 7 November 2006).

I got an extension for 3 years from 31 January 2009 - 31 January 2012.

I entered the UK only on 5 April 2007.

I fulfil all other criteria required for ILR.

My question: Will I have to apply for another extension to take me up to the 5 April date? If yes, what is the form I need to use? How will the HO know that it is a second extension to make up the 9 weeks to ILR?

Please help!

you can use the normal Tier1(G) application form but will fill in the Extension part.. not the Initial application..

though i am not sure you shd be fine with the 9weeks part?? as it is a BIG question that will they consider it as a part of those 225days out of country allowed or Will they take your ur clock start on 5APR07...?? sorry for confusion.. but it is not clear...

There are few discussions about the no. of days one cna be out of UK during the 5year term and still can qualify for the ILR.. though it is not final and the discussion is still ON.. pls take this as my view not anyrule:
To qualify for ILR the main applicant
1. can not be out of UK more than 180days in 5yrs
2. He should not be out of UK for more than 90days at 1shot..
3. It is Ok if he is on BUsiness/work related for 90day part

If you apply for ILR by post, I think you can apply 3 months in advance(one of my colleague did very recently). Explore this option, you can get away with extension. Otherwise you have to apply for extension.

Yes he got ILR. But I strongly advice to get this clear with HO (especially in email) first. Best way is to send them email and ask them if you can apply 3 months in advance by "post"?

Hi Mythili

I have tried my best on this forum to find an answer for this particular situation but no satisfactory reply.This is my research result

1 I assume that you are covered by JR of Apr 2008 as your application was before 7th Nov 2006.Read the clause 8 of policy document isued by UK border agency. Link is

It says that we will give you 3 years or sufficient leave to make you to qualify for settlement which ever is greater. This means they should have given you more than 3 years to take you 28 days window to apply for ILR from the date of your entry

2 For extension you should be covered by the same policy as above. You will not need to fill up Tier 1 form. Here is the link for form for people covered by JR

I will be writing home office soon to ask for sufficient leave to take me to ILR as per policy document. May be after couple of months once I am free
Friends on forum have not experienced such situations. If any friend has got ILR outside the permitted 28 days window please help us
