british citizen marrying a2 national

Post by britishrick » Wed Oct 28, 2009 6:17 pm

hi all, first of all thanks for taking the time to read this,

i have been with my girlfriend for 18 months, she is bulgarian and i am british. we have been living together for a month now in england and the purpose of this was so we could marry and live together here. after marrying her she is going to apply for her blue registration certificateconfirming her right to work. my question is can they refuse the application due to 'marriage of convenience'? i mean we have been together 18 months but only living together for 1 month and she has only just come to reside in england. the only benefit she will obtain from marrying me is her right to work, so does anybody know of any case where this has been refused???

thanks

not likely

Not likely to be refused unless it is a real case of sham marriage. She can live in the UK anyway, so it shouldn't be a problem. Another way to gain full employment rights is to study for a year, during this time she can work part time (20 hours per week). After a year of study, and payslips for 12 months, she will get blue registration certificate with right to work.

if she were to study for a year would she need to apply for a student visa in bulgaria and prove she has funds to support herself etc or could she just come and enrol on a course etc?

thanks for your reply

No

No, EU nationals do not need visas or any permission to study. She has to come, enroll, and then apply for a yellow registration certificate as a student(needed only if she wants to work part time).
