Not sure what you trying to ask here, but let me tell you this. If your visa is rejected and was not giving the right to appeal (or you don't want to), this means you must leave the UK within 28 days of the HO decision. If you volunteer to leave the UK within the 28 days, you should be able to apply with no problem and you wouldn't be considered as an over-stayer.
If you stay beyond the 28 day period, things will get nasty.
