Help regarding green card

Post by hs159 » Mon Nov 28, 2005 3:53 pm

Hello every one,

I need some information about US green card and I'll appreciate if you guys can help me out by answering my queries

Some background information .... I am working in UK since May 2000 and got my BC in June 2005 (based on 4 year work permit and 1 year on ILR). My wife is a US citizen and she's studying in Pakistan at the moment. We're actually married on papers not living together yet and she's going to move with me here in UK in few months soon after completing her studies.

I've got some queries with regard to US immigration/green card as I am pondering to make a move to US in couple of years time

* Is it possible for me to get a green card based on being married to a US citizen?

* If yes then what is the process of applying for it (any pointers or websites will be really helful)? and how long does it take?

* Will it be possible for us to file GC whilst my wife is living with me in UK or she's to be physically present in USA for a certain amount of time?

* One more thing to mention is that my wife wasn't born in USA. Both her parents were US citizens at the time of her birth and that is how she got US citizenship. Not sure if this matters in case of me applying for GC

Hope to hear from you guys soon!

Many Thanks,
HS159.

The US Consulate London will have the relevant information. Note that anectodal evidence shows the consulate's requirement for the petitioner (in this case your US spouse) to be resident in the UK is deemed as ILR. It may be that they accept a 2 yr spouse visa as definitive residence. The consular officer will likely review in detail that you appear to have lived separately for some time to establish the bonafide nature of your relationship. Good luck.
