HSMP - Dependants Application

I applied for the HSMP work permit from Nigeria and was issued it. Before I actually was issued the permit, my wife and two kids were already in the UK on a visit.

Now that i have relocated to the UK and have just got a new job, i am just ready to put forward the application for my dependants (wife and 2 kids).

Please, I like to know how i can go about it while here.

Since your wife and kids are on visit to the UK, they will have to go back to Nigeria for their EC.

I wonder why you did not wait for them to come back to Nigeria before applying :?: :?: :?: Are they visiting for 6 months that you couldn't wait, please let us have the true picture.

I am aware of the circumstances surrounding Martins, actually wife and baby came on a visit on a two year Multiple entry visa, but have overstayed the initial 6 months, i advised personally that getting het to come for the EC at that time could jeopardise his EC since the wife had kind of overstayed, so i advised he had the EC first of all and come, and then pursue his family's case, because at theis time he would have been in the UK under the programme, and we would have shut the door to EC refusal for him, incase the ECO hammers on the overstay of wife and then extend negative decision to him.

Papafaith thank you for making the true picture clearer.

I doubt if there is any other way out than coming back to Nigeria for the EC, no matter how hard or difficult the situation seems.

We have seen cases on this forum, where one partner has overstayed for several months if not years and still went back to the Home country and eventually got the EC.

I can understand Martins' fear of the family applying under this circumstance. Since he has been able to scale his own EC hurdle, with prayers the family will also get theirs.

My wife and daughter were visiting on a 2-year multi-entry visa and on arrival she had my second baby.

At this point, i decided they should not be in a hurry to return; and that was when sent in my application, and thought that it would come through soon. Things turned out in a way that it was going to be burdensome to have them coming back home when i was about getting the permit. so i got advice to apply for myself first and foremost (this time my family had stayed beyond six months).

What i still want to find out is: can't they (my family) get it here without going back to 9ja?

Bunto, can Martins not use the FLR form to extend the stay of his family for the remaining part of the one Year? Chess? John?

papafaith I strongly doubt this.
Though they are his dependants but they do not have valid EC that can be changed to another category...
They have to go back home to apply.....chikena.. But they wont be refused if martins can prove the necessary details. I hope the wife did not have access to public funds when she had her 2nd baby!!!
or can she be on NHS with visit visa???

Sorry, I don't think this is possible. I think a trip back to Nigeria will be necessary to apply for your family's dependent visas.

I think the only time IND might, by concession, agree to issue these visas in the UK is where very exceptionally it would be very dangerous or impossible to travel back, or where a medical condition means that such travel could not be be undertaken.

But what about the overstay on the visiting visa, will it affect their EC

I think kayalami once mentioned that for categories leading to settlement... overstaying will not be a problem since they are expected to make Uk their main home...

but come to think of it.. has her visa expired.. or its still valid but has stayed more than 6 months at a stretch???

visa is still valid but overstay was for the 6 months condition. she did not have access to public funds as i paid for NHS service.

dont think overstay will be an issue..since u paid for nhs service.. m ake sure she has the docs to prove this ooo when she applies.. they may ask her.
