Student Visa And High Court Appeal

Hi Everyone,

I originally applied for a PSW visa but was denied due to maintence reasons. I took the appeal all the way to the High Court as I believe I had a HR basis of staying as I am currently studying.

In the meantime I also sent an application for Student Visa.

I have recieved a response which states:

"You may apply to the AIT to have your application for leave to remain as a tier 4 student to be treated as a variation of your grounds of appeal. To this end, your documents have been retained on the Home Office file as they may be considered as part of your existing appeal."

Does that mean I have to just right to the AIT explain that I applied for a student visa and to take this into consideration when making their decisions?

Has anyone else ever heard of something like this?

Any help would be mucho appreciated.
