Post by girish » Fri Jan 01, 2010 10:17 pm

Hi
I) i was on a WP visa in UK for 1 year(Jan07-Jan08) = 1 year
II)HSMP Visa(Jan08-Jan10) = 2 years
I had been to India on official visit for a period of 4.5 months in the year 2009 i.e Jun-Oct 2009.
III)Tier1 General(Jan10-Jan13) visa =3 years

1. Can someone tell me if my eligibility to stay in UK is invalid since i had been out of Country for more than 3 months ?

2. Is there any way by which i can get rid of this?

3. Can i aplply for Tier1 extension again on an extension after 3 years, as i am currently under tier1(gen) extension?

4. Also,Can someone please confirm me the min. no: of years for applying ILR in UK .Is it 5 Yrs or 6 yrs?

By 'official visit' you mean that you were sent there to work by your company or you were on holiday?

If you were paid in UK ... and you paid NI + taxes and can show payslips + bank statement ... then you might still try to convince the case worker

You should be fine. Just get letter from your employer. Format of the letter can be downloaded from the below link.
