HSMP review succeeded; approval obtained

Dear All:

I am happy to let you know that yesterday I have received HSMP approval after my request for review and will be leaving for UK in few weeks' time. They rectified their error and granted me 50 points for specialist work experience, so I did not need anything else (I also had 15 points for significant achievement and 5 age points).

The review took exactly 2 months.

So no need for the Chartered Information Systems Practictioner, MBCS etc......

Thanks Chess; I actually got MBCS and am in process for chartered status anyway, as it helps in my consulting business.

Regarding EC I applied today and will pick up the passport tomorrow.

I like your confidence - you have proved many of us wrong by succesfully appealing...to be honest, I never thought you stood a high chance of succeding..

Presumably EC went OK and yoiu are just poicking up your ppt tomorrow..with that determination you might be the next Bill Gates - dont forget us tjough 8)

PAPA: you too.. determination and faith. Any progress in arranging courier / receiving approval letter?

My documents are lying in HSMP!!! They had took decision in my case on last wednesday and currently the case is with incountry team.

in what field you claim work experience and how many points you were claiming in the work experience section? Do they considere it as graduate level or not??

In rejection letter, they stated that "we are not satisfied with the evidence for 5 year senior level / specialist level experience".

I'm holding - Directorship of a company for last 2 years
- from 1992, i'm heading IT dept / team lead

unfortunately, i've not mentioned that these are the proof of specialized / senior level experience... Instead of that i've just kept all exp..letters and requested for 50 points based on 14 years exp...

I came to know about this BB recently, else i would have succeded in first shot.. (great job by workpermit.com and members)

I would be grateful anyone can give the info that (a) from where can i find HSMP (rev) (b) and to which address i should send

25. Appeals
25.1 Q: Can I appeal if my application is unsuccessful?
A: Applications from outside of the UK: there is no right of appeal for unsuccessful entry clearance applicants under Section 88(2)(b) of the Nationality Immigration and Asylum Act 2002. However you do have the ability to ask the HSMP casework team to review an adverse decision in respect of eligibility under the Highly Skilled Migrant Programme. A maximum of two reviews may be requested. To request a review the applicant should complete form HSMP (Rev)
Applications from inside the UK: whether you can appeal depends on your grounds for appealing the decision. If you are seeking to challenge the refusal to approve your application for eligibility under the Highly Skilled Migrant Programme then no right of appeal exists under Section 88(2)(b) of the Nationality Immigration and Asylum (NIA) Act 2002. However if you are appealing the decision on the basis that the decision is not in accordance with the Immigration Rules then there is a right of appeal. This may be heard by an immigration adjudicator in the UK under Section 82(1) of the NIA Act 2002. Irrespective, of whether you have a right of appeal before an immigration adjudicator you still have the ability to ask the HSMP casework team to review an adverse decision. This should be made on an HSMP (Rev) form which can be obtained from the Work Permits UK website at www.workingintheuk.gov.uk

Hi there

There is no HSMP(Rev); you just write to them at the Sheffield address and ask them to reconsider their original decision, pointing out why you think they are wrong. NO ADDITIONAL EVIDENCE CAN BE PROVIDED - you have to base your review request only on the docs they already have (they photocopy everything before returning originals). If successful you will receive the approval letter by post. When I did ask for review there were no review fees - I don't know if they apply now - look in the guidelines...

Thanks for the info.

I've not hi-lighted my specialised / senior level experience. That was the problem.
