hey tx for the reply. I looked in to the link .
However, I have another query :)

if a tier 1 dep visa holder , goes to his/her home country and applies for fresh tier1 ( tier 2) as per the guidelines & gets approved .what will be the visa status of the spouse( main applicant, when he was in dep visa). If he/ she is still with her/ his tier 1, can the spouse apply as his dep Visa once dep visa holder gets the fresh tier1?
I hope I am clear.
Tx

The status of the Tier 1 (General) main applicant is not affected at all if the Tier 1 (G) dependent changes his / her status to either Tier 1 or Tier 2 main applicant on his / her own merit.

The Tier 1 (G) main applicant cannot make an application for Tier 1 (G) dependent from within the UK. He / he will have to return to his home country and apply for EC as Tier 1 (G) dependent form there.

FYI - Both partners can be on Tier 1 (G) status - as main applicant - individually. It is not mandatory for one to be a dependent of the other.

I believe it is possible, but not 100% sure! Best that you check on this one with UKBA directly.
