Child born to Tier1 Holder in the UK

Hi,

My son was born last month, I am on a Tier 1 visa, what is the process?

Do i need to apply for a full dependent visa for him, including providing proof of income and maintaintance of funds?

1. Passport (Sryrian?)
2. HSMP / Tier 1 dependent leave to remain.

If HSMP approved before 07 Nov 06, check with UKBA which form you should use for dependent LTR. Else, use the Tier 1 dependent form.

Do you need to? As in, is it compulsory? Well no, your child is not going to get thrown out of the UK if he does not have a visa.

However, prior to you applying for your next UK visa, do you intend to take your child outside in the UK? If the answer to that is yes, then yes, you need to get a UK visa for your boy, otherwise he will not get back into the UK!

But if for example, you are applying for your next ILR visa before your boy will leave the UK, just include him when you make your next application.

Apply for the Tier1(G) dependent visa for your son...you have to fulfil all the formalities related to this... Process is same as dependent visa application..

you need following once u get him a passport at the BHC..

1. Birth Certificate
2. 3months maintenance funds for 3of u...
3. copy of ur passport n visa
4. 2 x photos
5. cover letter

No, you don't have to, except to get the child back into the UK ..... as I state above.

For example, if the OP is applying for say ILR in 6 months time, and there is no intention to take the child out of the UK before then, just make sure he is included in the ILR application.

I always had impression that parent need to apply for new born kid's visa within six months of birth(if living in UK) or immediately if planning to travel outside UK. Not sure where I read that.

This subject is fully covered by this UKBA document.

In particular, about half way round the first page :-
This section relates to children born in the United Kingdom on or after 1 January 1983 who are not British citizens because, at the time of their birth, neither of their parents was a British citizen or settled here. Such children do not have the right of abode and are subject to immigration control. They are not here unlawfully, however, and are not required to apply for leave to remain
So as I said before, include the child in the next visa application, except if the child in going to leave the UK before that, or rather needs to return to the UK before that next visa application, then in which case a visa application for the child needs to be made separately.

Its always better to get the dependent visa done as and when you are ready to apply as you never know when you have to travel in emergency/ unavoidable travels..

TVN, well said. No one knows about emergencies in life. However, I would like to add one more point to what John have said earlier that if you can wait till you apply for your ILR.

BUT

What if he still does not include the child in ILR applicaiton and apply for child's naturalisation once he gets his ILR approved under 1(3)? Would save him hastle and money too.

Well yes, except the child application would be Registration as British, not for Naturalisation.

But as the extra for adding the child to the visa application would be just £50, maybe best to pay that.

The background to all this is of course ...... yes there may be lots of good reasons to apply for the child visa .... but what is not correct is that it is compulsory to make such a visa application. That is clearly confirmed in the UKBA document I provided a link to.
