REFUSAL FROM DOJ RECIEVED ON THE 27/01/2010

Hi everyone we recieved a letter of refusal from DOJ for the residence card.
They said that I the Eu citizen is not exercising my rights and.
They continue to say that according to their records the applicant has no legal status in Ireland,and notification under the provisions of section 3/4 of the immigration Act 1999 as amended.
So they have given us two choices ;

1. to submit representations under section 3 of the immigration act 1999.
to the following department Acknowledgement unit repatriation section inis 13/14 Burgh quay.
2.or request a reviewfrom eu treaty rights doj.
Can anyone explain what they mean by residence card is that the 5 yrs and what is the difference between the residence card and stamp 4,because they have not given him anything.
Should we take the first option or ask for a review from the eu treaty section.? Thanks

Your message very unclear. Calm down and let get it from the begin

You need to give us details as to why did go with EU treaty etc...
Example:
I was a student, living lawfully in Ireland (valid visa) until 2000 and got married with an EU citizen from Ireland. My husband/wife have a job, we own a property etc... We've living together for 9 years etc....
I wanted to apply for residency based on my marriage to an EU citizen etc...
we submitted the following document etc...

My status currently is that I am working etc...

In order for us to help, we need details.

I am a uk citizen living in Ireland my husband is a foreign national we have been togther for four years we have a child and we married in dec 09.I am currently an active jobseeker on a basic supplementary welfare.
We provided them with eveything they asked for.

A residence card is the proof of having received legal residency in Ireland.
In your spouse's case, if successful, he would be issued a residence card
containing the text 'stamp4 E.U fam'.
