can review refusal be challenged???

Post by hubroom » Tue Jan 03, 2006 9:46 am

I have got my hsmp application refused, points claimed 85, awarded 50 for earning and education and 0 for experience.
First review refused, 2nd review refused too. Both time the reason is one line statement that the work you have done in you jobs does not satisfy the HSMP team to award the point. NO EXPLANATION WHY??? The exprience letter from employer is very detailed one as per HSMP guidelines and the 5+ year work is related to Telecom engineering work, as senior engineer and management positions.

How can i challenge these decisions? I m totally unsatisfied with the replies from HSMP team.

Could you please post your employer's reference/testimonial to this website so we could have a look and tell you where things might have gone wrong.

hubroom,

Call the casewroker and ask him more details. he will give more details. also ask the caseworker email, he will send you more details.

Compare that details with Caseworker Guidelines.

Hi all,

I have called up the case worker,

on skilled partner (I am married since May 2003, my wife is also software engineer (Post graduation in Computer Application) and currently deputed in UK). We have provided 8 proofs 2003 - marriage certificate, in 2004 (telephone bill on wife name, and gas bill on my name) and 2005 (loan agreement, joint bank atatement).

Comment: they are saying you have not given any proof (joint) in 2004, so it does not prove that u were staying together, the two address proof (with different name) has same address, as per the guideline, if for a year we are not able to provide joint proof, diff. proof on individual name with same address will work (that is also only for 2004, as 2003 and 2005 we have joint statements). they awarded 0 points in this stream.

On work exp I have around 6.5 years of exp. (3+ in specialist role)out of which they are considering only 4.4 yrs of exp (i applied in sept), as jos and responsililty erf is there since apr 2001. before that i was working in a company which is working with a different name now, but they are saying we dont know it is graduate level exp. now it is already jan means now on paper (with written) exp is around 4.10, and my job title was of a graduate level and i joined job after my Post graduation, as per guideline if person is not able to get the ref in specific format it depends on the caseworker and all other exp to award points...
but they have awarded 0 points on this stream.

I wanted to call them again and talk with them, any suggestions are most welcome... please help .......... i m really bery disappointed with the decision and review decision too :(

thanks in advance for all the suggestions.

I dont think your further review requests would be considered as it has been refused twice.

Since you know what is missing, the best idea would be to re-apply and ensuring that you provide all missing documentation.

Good luck with your new application.
