Hello Friends,

I am a holder of Tier 1 General Migrant visa. I got my visa on 23rd Oct 2008. I have not traveled to UK on Tier 1 visa till now. Due to family issuse and also official commitments. However I have traveled to UK twice after 23rd OCT 2008 on Business visa.

I got engaged in Feb 2009 and got married in April 2009. Now I wish to travel to UK along with my wife and I an about to apply for my Wife;s Tier 1 Dependant visa.

My question is:: Will there be a problem in getting a visa or at the immigration (assuming I get a visa and I travel to UK) because I have not traveled for 1 year 3 months after getting my Tier 1.

Please guide me on this. I am planning to apply for visa on 12th Feb 2010.
My visa is valid till October 2011.

Please guide me friends.

(NOTE:) I do not have UK company offer letter.

There will not be any problems for getting your wife's visa. You have to show appropriate maintenance fund for her, along with yours, as per the guidance.

Business visa overrides your Tier1 visa. So I fear, you need to go for Tier1 again.

@Gotcha: Can you please elaborate on your comment. I have had two business visa's and both of them are NOT valid now. Most recent business visa expired on 26th November 2009.

I am afraid I cannot go for re-applying Tier1 because according to new rules it needs Masters degree.

Sanjay, I could not find link having information. But, I'm quite sure, new visa replaces existing visa. Drop an email to BHC in India to confirm this.
I wonder, why you needed to apply for business visa, when you could have travelled with your tier1.

Hi All,

Can anyone kindly clear my doubt,
I got Tier-1 visa valid from 21 jan 2010, Have not travelled yet.
now would like to apply for my wife and go together,

My over all perception that I need following documents,
1] Covering letter
2] marriage certificate
3] bank statement of min.3months 1600+2800 GBP ( have not travelled yet)
4] bank letter stating regarding min and max amount in my account
( optional)
5] Letter from UK house owener ( optional)
5] photo and passport of wife
6] my original passport or copies of visa?!! kindly clear this .

anything I am missing?

@gotcha: Thanks, Can you please provide me with BHC email address in India.

Gotcha. actually I had a business visa ( for company work) before applying tier 1, then I applied for Tier 1, and again due to my company's needs I had to travel again issuing another business visa (earlier bv had only 6 months validity).

I had raised the same point in my company as you said but the 'Travel dept.' in my company said that we cannot allow you to go on Tier1 for company's work, you would require NI number if you enter UK on Tier1.
So there was a need to apply for another business visa.

The 'Travel dept. guys' may be wrong but I really did not have much time then. to delve into immigration rules and all.

Hi,

I emailed BHC but no reply till now. I called up VFS and they said that Tier 1 and Business visas are totally different and they do not have any information on Tier 1 and Business visa conflict situation.

If any body knows about this situation please inform me.

Thanks for your reply. I am really confused by all these immigration laws. The more I read , more I get confuse.

I have three UK visas stamped on my passport
1. business visa (Issued on: May 16, 2008: Expired on November 15 2008)

2. Tier 1 general migrant (Issued on 23rd OCT 2008, Expires on 22 OCT 2011)

3. Business visa (Issued on May 27 2009, expired on 26th Nov 2009)


MY EXPERIENCE:

I traveled to UK on business trip on 28th May 2009. (at that time I had two visas valid tier 1 and BV). At that time the immigration officer asked me on which visa are you traveling?

I said on business visa as I am here in the UK only for a week for business meeting and I do not intent to work.
After saying this I asked can I enter UK now on Tier 1 visa?

The officer said Get your Tier 1 visa stamped when you plan to stay in the UK. Now I am stamping your business visa.


I am really confused and not able to find concrete information on 'First Enter' to UK on Tier 1.

BHC people do not reply. I emailed them twice at bombay.visaenquiries@fco.gov.uk

I did not get any reply. Do you have any idea how much time they take to reply?

If they think your mail is worth replying to, it may take upto 20 working days. :lol:

Called up VFS they said that Tier 1 general Migrant visa will be INVALID without any notice if Business visa is stamped after that.

This is a shock to me.. lost 1.25 lakh

I'm not sure about it. I'm confused by IO's words with you.Otherwise , you don't have any option I reckon.

Agree with many n vfs guys here that BV overrides any previous visa's (Tier1/Tier2)

In any case I will have to pay 54,000 INR again na?

And I guess re-applying is not an option for me since now they require Master's degree for Tier1.
