INR salary earned in India but received while I was in UK

INR salary earned in India but received while I was in UK

Hi,

In my company they give variable component(VC) of salary quarterly, so e.g.

Apr to June VC they give us in July pay slip.

In my case I was in UK pre April and came back to UK in July – (Apr to June in India).

In my July offshore pay slip there is break up given for VC of April to June and rest as July basic pay.

Query:
1) Can I break up my July salary in 2 parts and claim uplift factor on VC component of it(as in April to June I was in India though I recd in July when I was in UK)
2) And for July basic covert to GBP without adjustment factor

Your view is really important as my case is of border line and with VC uplift I gain 5 points.

Please give your expert opinion

Depends on how well you explain it to the caseworker! If you confuse the caseworker or make things complicated for him/her to understand, you risk the success of your application.

There are few questions to be known clearly before answering your query:

1. How long did you work in UK?
2. How many salaried months you are claiming from UK?
3. Are you claiming UK Experience points


If point 2 is greater than or = 12 or point 3 is yes then you can Not use uplift factor??

Also, let Senior's confirm this..

Vraj: Period of UK experience want to claim
Jan 09 to 15th April 09 - 3.5 months and
15th July to Dec 09 - 5.5 Months = Total 9 months or 10 if we ignore April and July month of duel country stay

Sorry 1 more question Can I claim uplift for May and June 09 when I was actually working from India and received my salary in India?

Vraj: I am claiming past experience of Jan-09 to Dec-09 and UK salaried months are 9 + 1(if we can count april half month salary received in INR on settlement)
(My overall work experience in UK is 2.5 years in 2 breaks
Mar 07 to April 09 and July 09 to till date)

3. Are you claiming UK Experience points
Vraj: Yes, my UK GBP earning is more than 16K in Jan 09 to Dec 09 period

I reach points requirement if I can uplift for May and June (India working), If I can uplift Variable Component (VC) amount of April to June It gives me margin of safety(earn more 5 points).

Please advice.

As per my knowledge u cannot use uplift factor in this situation but i could be wrong... Seniors pls help...
