My congrats abidjan1,
Just one last thin, how did you proove your 6 years of residence? did you give 6 years worth of payslip for yourself and your wife? did they ask for anything else? does your letter say anything about processing time?

Thanks again mate!

At the competion of five years from the date you started using your treaty rights. Should have 1 year on PR or ILR before applying for BC. You also have to qualify for for residence requirement. Details as follow :

hi pat grey

you can apply in december 2009 depending on the date your 5 years were issue. eg if your 1st 5 yeras stamp was dated 10 december 2003 then you apply on the 11 december2009.
good luck

Abidjan1, I know you have naturalise using the same process but I am not agree with you. It should be five years from the date Pat started his treaty rights not the date visa was stamped on his passport. Because that stamp merely confirms his rights.

I submitted my application via NSC last week.

I had no issue with explaining the PR stamp being less than 12 months old as the lady rang HO and they confirmed this was ok.

The only documents they phtocopied (and they rang Home Office to check this) were:

1. My passport covering the last 5 year period
2. Marriage certificate
3. Spouse's passport
4. Life in the UK pass certificate.

I showed the lady the Guide and referred her to the list of documents for EEA national application and she checked with her superviser and said this was for people who have not gone through the process of applying for permanent residence. My application will be based on 5 year residency.

I just took her word for it and will wait to hear from HO.

Just thought I would update you guys. Anyone else applied using this route recently?

I would love to know what documents they requested from you.
