They simply mean its not a route to residency, because it is issued only once and for 2 years only, and the minimum PBS period to qualify for resident is 5 years, which is only obtainable in Tier 1 and 2 General as they can be renewed and maintained until 5 years but PSW cannot be renewed or extended to complete the 5 years.t070576 wrote:Exactly! it is lawful residence. Even stay in UK as a student does not count towards ILR. So, going by your own assumtion, you shouldn't qualify for ILR at all!! Where did you get the information that time spent as student counts towards ILR? Where is it written? Therefore, shouldn't you assume that even after spending 10 years in the UK (8 years as student + 2 years on PSW) you do not qualify for ILR??
What is the basis of ILR based on 10 years' long residence? 10 years of continuous lawful residence! If the 10 years you've lived in the UK have been lawful and continuity has not been broken, you may qualify for ILR under the 10 year rule - irrespective of your immigration category during these 10 years.
Read Immigration Directorate Instructions (IDI) on long residence *carefully*!
