PSW to Tier 2: Does my employer need license?

Hello,
I am living in the UK on a PSW visa. I have been working with a company for more than six months now. They are ready to give me a COS. But the company is not licensed so far (well, they did not need to be so till now). So, before they can issue me the COS for the future, do they have to obtain the license first?

Or will be a part of my switching application?

Any input will be greatly appreciated!

Yes .... otherwise they cannot sponsor you.

1. If the company is ready to give u a COS then if they do not register with UKBA, how wud they issue a licence?
