claiming benefits

Hi friends,

I am a successful candidate of HSMP and currently in UK (since September 2005). though i haven't yet got a job in my specialised area, but have been lucky to get a job to survive in hardly 3 weeks of my arrival. My family is also here with me now.

I remember reading a thread in past regarding the tax credits/benefits that we can claim being on HSMP, if anyone can still advise me, i will be highly obliged. I knew that there was a link on homeoffice's website as well where it stated that further info regarding the benefits/public funds could be recieved form there, but i could not find that linki today. can anyone of you help me forwarding the link and other info?

Check your visa to see if it says "No recourse to public funds".

Indeed but that thread probably said about the highly complex nature of the Tax Credits (Immigration) Regulations.

Given that your disclosed location still says India .... you might like to change that! ... I guess that all of you and your family are Indian? If that is the case then no, it is not possible to make any claim for Child Benefit nor for Tax Credits. To do so would be a breach of the visa condition already mentioned above by Dizzeem.

Some countries, such as Turkey, have signed reciprocal agreements with the UK and thus had all of you been say Turkish then some claims would have been legally possible, even with the "No recourse to Public Funds" restriction. But there is no such agreement with India.

Thanx dear John, what a lovely reply forma moderator.....

Just to confirm that, if you woudl have read my posting carefully, i never said to claim clild tax or working tax credit, those were just the examples of tax credits, i wanted to know something similar to that that I had read in past. Anyways, i think the mood of moderators (or at least singular) is not such of helping others and its just of criticising other taking their nationality as an instant.

There are just two types of Tax Credits ... Working Tax Credits and Child Tax Credits. It appears that you are not entitled to claim either. Nor is a claim for Child Benefit possible.

The list of Public Benefits? That can be viewed by clicking here, but do appreciate the IND website is rather slow at the moment.

Look at the Public Funds definition in paragraph 6.

Other benefits from the UK Government? Totally OK to claim them.

And as already said, even the Public Funds list is subject to bits of "small print" in other legislation.

I don't see anything wrong in the 2 replies you got... what makes you think you have been criticised ?

Since there are just 2 types of Tax credits, what else do you want the be considered when replying to your thread?

looks like you are frustrated because you have still not landed a job in your chosen field and the pressure is mounting on you day by day.....
