UK work permit switching to Tier1 after 6th April 2010

Hi,
I hold a UK work permit working from past 3 years. I want to switch to Tier 1 visa.
As my previous earnings will be disclosed from UK , how may months payslip should be disclosed to gain maximum points in earning according to new rules after 6th of april 2010.

Earnings should be declared including Tax or excluding Tax ?

12 consecutive months of the past 15 months! Points that you can earn comes from the amount of money that you have earnt than the number of months you show!

you can claim points for Maximum of 12 months within 15 months prior to your application

Just another question, the earniing declaration should be including or excluding Tax?
The reason to ask is i am qualifying for Tier 1 if ai am declaring my pay including tax and i am short of 5 points if i declare excluding tax.
