Previous earnings period

Previous earnings period

From Tier 1 guidance:

- Earnings period we will assess -

99. The applicant can claim points for previous earnings in any single, consecutive 12-month period during the 15 months immediately before the date of applying.

100. All the periods we specify are calendar months (for example 14 January – 13 February).


My question is:

Can I claim period from 15.01.2009 - 14.01.2010. as 12 months?

In that period I received salaries from Dec 2008 (received 15.01.2009) up to Dec 2009 (received 14.01.2010). That is salaries for 13 months (!) received within the 12 months period claimed. I also received 3 bonuses in that period.. so I want to claim total of 16 payments from one employer into my bank account.

Is that OK according to rules in guidance???

Yes you can. It is any salary/bonus earned during a consecutive 12 month period in the last 15 months. It doesn't matter how many salary payments you received or how many bonus payments you received - provided they all fall in that 12 month period you are claiming upon.

That means I can claim 13 salaries... only because my company puts payment into my bank account on a different day each month.

Yes, but you probably want to explain this in your cover letter just in case. By the letter of the guidance notes, then it is possible, because the guidance notes specifically state you can claim salary and bonuses from the 12 consecutive months within the last 15 months.

Remember the case worker treats every case individually, so that means they may potentially not accept it (i.e. the 13th month salary. The bonuses can be included no problem), but its better to write it in your cover letter explaining that. If I were you, I'd claim on the 13th month, but make sure than even without the 13th month, I will still be eligible.

But all in all, but the letter of the guidance notes, it should be possible. This is my take on it. Maybe someone else can chip in on it. I'm not exactly a official source.

Yeah agree with Sushil, i dont think one can claim for 13 months and what one earned for the actual period he/she worked for will be considered.

Hm.. are you sure?

then, on payslip for a bonus that I received in March 2009 is written "Award for 2008"...
Does that mean I cannot include that bonus in my "15.01.2009 to 14.01.2010" period???

Because I actually worked during whole 2008, but got paid (received the bonus for that work) in Mar-09.


There should be strict rules about this.. this guidelines can be easily misinterpreted :?
