CAN I APPLY FOR ILR THIS APRIL 2010? (PLEASE HELP)

CAN I APPLY FOR ILR THIS APRIL 2010? (PLEASE HELP)

Dear forumers,

I will appreciate your help immensely as I am a bit confused. I like to know if I am qualified to apply for my ILR now (April 2010). Below is a breakdown of my visa history:

1. Work Permit Visa (From 16 February 2005 to 31 July 2005)

2. Work Permit Visa (From 30 Aug 2005 to 31 Aug 2007)

3. HSMP Visa (From 28 Sept 2007 to 28 Sept 2009)

4. HSMP Visa: Tier 1 {General}Migrant (10 Sept 2009 to 28 Sept 2012)

Do I qualify to apply for ILR now (April 2010) and if yes, under what category will I be doing this?

There are gaps between your visas (30 days in Aug 2005 and 27 days in Sept 2007).

Were you in the UK during these gaps? Was there an application with UKBA for FLR during these gaps?
Were you employed in the UK during these gaps?

If the answer is "no" to any of those questions, you may have broken your continuity of UK residence and you do not qualify for ILR this month.

If you want to discuss further, please give a timeline of your employment status and absences from the UK.

Thanks so much for your response. Most grateful. The gaps are the times taken by the Home office to renew my visa. I will usually put my application forward in good time only to receive the renewed visa with the gaps you have identified.

Secondly, I was working during those times and was in the UK too so haven't broken my continuity of UK residence.

Lastly, since 2005, I have always resided and worked in the UK apart from holidays I take annually to the USA which totalled 111 days in the last 5 years.

I hope I have been able to clarify things a little bit. Now what do you think?

By the Sounds of it - looks like you can apply for the ILR.

You current status is Tier 1. However you may have to provide all your docs from when you first had your WP and the 5 year clock ticking...

You can visit the UKBA website for more info and also there are certain threads with "Success at PEO" which have people on WP+HSMP+Tier(1) and all other sorts who have their ILR granted...good to start reading their posts to get an idea..
