Tier 1 eligibility on Indian Salary and UK Salary component

Hi,

I am planning to apply for Tier 1 UK Visa (General) under the new rules - 6th April 2010. I am currently working in UK for a Indian MNC company and under Tier 2 Intra company transfer. Basically I need a help and advice since I am scoring 70 points and just short of 5 points.

My annual salary comes to around GBP 33K and I am short of GBP 2000.
I want to provide the following details in support of my application:
Age: 28 (20 points)
Bachelor Degree: (30 points)
Previous UK work experience : (5 points)

Past 12 months of Earning:
Salary for 3 months in INDIA (BAND D): INR 120000
The GBP amount for the above Indian Salary is 1591.2 and converting it to UK equivalent comes to GBP 8433.36.

Past 9 months UK Salary of GBP 24500.

Total Salary in GBP for past 12 months : GBP 32933

So my past UK earnings points is 15 points.

Query:
In my case my company pays me an Indian component of INR 14000 per month while I am deputed in UK along with my UK Salary. They also show this component in the Gross UK salary.
Please find below my UK Salary structure:
Gross UK Salary: GBP 2700 (broken down as below)
Income:
Basic Maintenance Allowance: GBP 2500
India Pay: GBP 200

Deduction:
India Pay: GBP 350
Income Tax: GBP 200
---------------------------------------------------
Net Pay :GBP 2150

a) Is it possible to exclude the India pay amount of GBP 200 while declaring the UK Salary and declare the India component i.e. INR 14000 ( converting it to GBP 205 - converting it to UK equivalent i.e. multiplying with 5.3 = GBP 1086) along with the UK Salary?

b)Or is it that only my UK Salary is accepted while I am residing in UK?

c) Or can I apply from India considering my monthly average is around INR 40000?

This makes me eligible for the Tier 1 Visa.
I will need some valuable advice if I can apply it in this format.

Please help me immediately.

If you were in UK physically then
- you cannot use 5.3 multiplier on indian salary.
- you can claim only indian salary if you want to but you cannot use multiplier as you were physically present in UK.

Do whatever you want .. but make sure don't represent false information as it is subjected to 10 year ban. ..... so please be carefull.

Wait for some other seniors if they have better ideas around your problem.

Agree with this assessment. If your India salary is already included in the UK payslip and itemized, then you cannot include it separately as that will be double booking. Also, the multiplier does not apply if you have been living in UK throughout the claim period even though a part of the earnings were paid in another country.

One more query:
Any pointers for securing a Tier 2 job initially in UK and then switching to Tier 1 after sometime.
I am working as a Senior Developer in Java and J2EE technology.

You may apply if you wish to, but will lose the application fees if the application is refused. For Tier 2, join an employer in your home country who has operations or customers in the UK, and get them to send you onsite on a Tier 2 (ICT) visa.

If you are more open to ideas then Canada should be another place you should be look for.

- easy to get Permanent Residency (most people get PR even before landing to canada ...)
- 3 years out of 4 years if you stay you get citizenship (after you get PR)

Looks like you are in Infosys mate. Get out of there from dispensation to non-dispensation.
