Advice needed

Post by mouche202 » Fri Apr 09, 2010 10:37 am

Current situtation:
Husband: In UK for 4 years 9 months - entered in July 2005 on Work Permit. Has changed employers many times, each time applying for a new work permit and receiving. Last change in January was to Tier 2. Not eligible for Tier 1.

Me: In UK for 3 years 7 months on Tier 2 dependant (have gone through most of the visa changes with my husband). Eligible for Tier 1.

Problem: Husband may lose his job in the next few weeks - just 2 months before ILR can be applied. He is trying for a different job but need to know options in case he is unsuccessful. In the meantime, I am planning to go back to India to get Tier 1 as a backup plan.

Questions:
If I reenter UK as Tier 1 holder and in the meantime, my husband manages to find a new sponsor and eventually manages to get PR, what are our options?
I have been told on the Tier 1 board that if I want to apply for PR dependant at that time, I will have to go back to india and apply. I understand the processing times for this kind of visa in India is quite high.
Suppose my husband gets PR and I remain on Tier 1 - which I guess will be valid till May 2012. He can then apply for naturalisation in July 2011. Can I then apply to stay in the UK as his wife? Or do I need to go back to India?
As per my understanding, I can stay for 2 years as his wife. After that I will have had 3 years residence in UK as Tier 2 dependant, 1 year as Tier 1 and 2 years as BC dependant. Will I then be eligible to naturalise?

Sorry for the complicated question - we are very confused as to what is the best thing to do at the moment in order to stay in the UK and if possible to get PR in July.

Your plan will be very expensive, but it is a solid backup.

Best/cheapest scenario: Your husband gets another job soon and you both get ILR in July 2010.

But if you go the Tier 1 route:

You get Tier 1. Husband gets new job and ILR in July. You can switch to spouse visa from Tier 1 while in UK this year, visa will be good for 27 months. After 1 year your husband will be a British citizen (July 2011). Sometime in late 2012, you can apply for Probationary Citizenship.

OR

You get Tier 1. Your husband can either get new Tier 2 until ILR or if he can't get a job he'll be Tier 1 dependent. You both have to wait 5 years to become Probationary Citizens.
