Facts:
Applying for Tier 1 from UK. Period of earnings claiming are from Jan to Dec 09. Applying by Feb 10(last week)
Earning Period, Country, Currency, total months
1) Jan 09 to April 09 – from UK – GBP, INR – 4 months
2) May 09 to June 09 – from India – INR – 2 Months
3) July 09 to Dec 09 – from UK – GBP,INR – 4 Months
Total GBP earnings more than 16 K in this period
Queries:
1) Can I claim uplift for May 09 to June 09?
2) Can I claim UK experience as my GBP earning more than 16K ?
3) If we claim more points than their assessment but even after their assessment they determine 75 points. Will they reject application as I claimed higher points than that of their assessment or they will accept it with fact that it is still achieving 75 points ?
So unless you claim that (all) your income in the 12 months was in the UK, you cannot claim points for UK experience.144. An applicant can claim a maximum of five points if he/she has either:
• successfully scored points for previous earnings and those earnings were made in the United Kingdom; or
• undertaken a period of full-time study in the United Kingdom, of at least one full academic year, and been awarded a qualification at bachelor’s degree level or above. The qualification should have been awarded no more than five years before making the application.
