What is your nationality now? And in which EEA country are you exercising Treaty Rights? And in what way are you exercising those Treaty Rights?

If I am joining/accompanying my wife to any EU state we can stay there unconditionally up to 3 months and that would also be considered as practicing the treaty rights.
Any State except her own - she would have to be exercising a treaty right in another EU state other than UK. You didn't apply for the EEA FP for entry to UK did you?

the reason they gave me is -
The proof provided by you to establish the purpose and the conditions of your planned visit does not appear to be reliable;

Where as I have given them a lot of documents showing approx 2800GBP in my wife`s account , hotel and flight booking, insurance for a 14 days holiday.

What exactly did you apply for? A Schengen visa? Or what?

All they have here is an option of Short Stay which is Schengen Visa or Long stay which is Family Reunion. Although I met the Visa officer while my application was delayed, she confirmed the directive and was aware that I am applying under the directive, I got a rejection.

Goodtimeassured, it does not help your case by starting a new thread over the same issue!
The end result is that members are now asking you questions which, if you had continued in your old thread, they would have understood where you're coming from!
Try to keep it in one.
For those of you trying to figure out what his case is about, here's the origins...

Perhaps part of the problem is that your wife is currently in the UK and not in Italy, where you are applying to go?
The proof of reservations and travel tickets that you gave to the embassy, did they include your wife as well? Or were they just for you?

Sorry mate, but your wife is british and lives in britian, and you live in India, so which ec directive is there to help you as she isnt excercising treaty rights?

Freedom of movement itself is a Treaty right and entry to EEA member states is a right that they hold. For all member states except the UK, the motive for their entry is irrelevent, be it for a holiday, passing through, or to look to reside and/or work.

It seems to me that Italy believe that he will stay in Europe while his wife returns to the UK, this would be the only justification they have for questioning that he wont return to India. However, they should still issue the Visa as they have fullfilled the requirements to show that he will be joining his wife (the EEA Citizen) in Italy and they are NOT required to show that they will leave, nor that they have sufficient funds before the 3 months is up.
Husband issued with an EEA FP via Surinder Singh and various complications :)

No, but your knowledge of EC law needs expanding.
