Planning to apply ILR SET(0) - Please share your views

Post by shs213 » Sat Apr 24, 2010 1:48 am

Hi All,

I am preparing for my ILR application, Just wanted to run by my case for some feedback…Please let me know if you think I have prepared enough and what I need to look at [if at all]

Visa History

Sep 2003: Came to the UK as Student

July 2005: Granted WP – it was in country stamping [ILR clock starts]
June 2006: Left employer

I have the P45 to confirm the time I left - but misplaced the Payslips /P60 issued in this period.

June 2006: HSMP
Married in 2007 and wife joined as dependant in 2008.

Self employed from June 2006 to Feb 2008

Since Feb 2008 to-date I have been in permanent employment – between two companies.

June 2008: Tier #1 for Main and dependant
June 2010: Eligible for ILR = 1WP+2HSMP+1Tier#1

I am planning to provide below, unless advised otherwise :D

1. WP letter they issued back in 2005
2. P45 – issued in June 2006
3. P60 – April 2007, 2008, 2009, 2010 [Awaiting by post]
4. Payslips + Bank statements for the last 6 months…
5. Letter from Employer
6. Covering letter
7. Schedule with absent days
8. HSMP Approval letter from 2006

Back up documents

1. More Payslips + Bank statements – in total covering last 12 months
2. Marriage certificate from home country, written in native language and in English
3. Council tax / Joint bank account statement.
4. All P45 issued for the period in scope.

Worries

1. I remember there was a letter with Tier#1 visa in 2008 – I can’t seem to find this.
2. P60 issued in April 2006 is missing plus I don’t have any payslips in my WP year. As I changed banks, I don’t have bank statements too.
3. The earnings in some P60 show misleading earnings. This is because I moved jobs and P60 show “earned in this employmentâ€

It all looks fine, do take your pay slips and bank statements of where ever you have a gap of P45/P60. Worth a try getting the docs for 2006 although it may not ultimately matter, as you did get HSMP after that.
If your wife came on your HSMP visa, then she will get ILR at the same time, her absences do not matter.
Best of Luck
