Citizen by birth?

My cousin was born in England. At age 4 his father died and his mom took him to Pakistan. He's now 20 years old and wants to come to live in England.
What's the procedure he should follow?

Please Advise.

What were the nationality of his parents?

If my calculation is right your cousin was born around 1990.Well those born before 1987 in uk have automatic rights to british citizenship. The citizenship of those born in UK after 1987 depend on the nationality and the immigration status of the parents.If one of the parents has ILR when the child was born, then the child has automatic british citizenship.If any of the parents acquired ILR after the child was born,then the child should be registered using MN1 form.So it is difficult to answer your question since I do not know the immigration status of the parents of your cousin.

The child is actually now an ex-child ...... aged 20! So form MN1 not appropriate.

Let's find out about the parents' nationalities and UK immigration status, before taking this further.

You are right John,MN1 is for under 18 years

He was born in '89.
Sorry about my earlier misquote... he was 2 not 4 when he left Cambridge.
His mother is Pakistani. His father was also Pakistani.

But what was their IMMIGRATION STATUS in the UK at the time he was born? No matter they are/were Pakistani! It is their immigration status at the time, that will determine his fate.

Are the parents of your cousin still in UK? If so I think they might have qualified for British citizenship looking @ the length they have been here 20 years and over.

Troubled, OP has already said that the father of the person in question died when he was four years old, and his mother took him back to Pakistan!

His dad was on student visa. His mom was on visa as well. The only thing going for him is that he was born there.

He now needs to look at his visa options like any other foreign national and should review the UKBA website to fully understand his options open to him.
