Any State except her own - she would have to be exercising a treaty right in another EU state other than UK. You didn't apply for the EEA FP for entry to UK did you?goodtimeassured wrote:I am Indian and currently in India and the Mrs is British. Correct me if I am wrong - I think the entry visa does not need you to be qualified. If I am joining/accompanying my wife to any EU state we can stay there unconditionally up to 3 months and that would also be considered as practicing the treaty rights.

The proof provided by you to establish the purpose and the conditions of your planned visit does not appear to be reliable;
Where as I have given them a lot of documents showing approx 2800GBP in my wife`s account , hotel and flight booking, insurance for a 14 days holiday.
All they have here is an option of Short Stay which is Schengen Visa or Long stay which is Family Reunion. Although I met the Visa officer while my application was delayed, she confirmed the directive and was aware that I am applying under the directive, I got a rejection.John wrote:What exactly did you apply for? A Schengen visa? Or what?
Freedom of movement itself is a Treaty right and entry to EEA member states is a right that they hold. For all member states except the UK, the motive for their entry is irrelevent, be it for a holiday, passing through, or to look to reside and/or work.mrlookforward wrote:Sorry mate, but your wife is british and lives in britian, and you live in India, so which ec directive is there to help you as she isnt excercising treaty rights?
No, but your knowledge of EC law needs expanding.osman wrote:I am a wife of uk citizen, after my 2 years spouse visa finished, i applied for PR visa, but i was rejected, I appealed but i was unsuccessful. me and my Brithish husband want to live in one of the english speak EEA state, will my previous history effect me to entry EEA?
