Naturalisation and Jobseekers Allowance

Hello everyone. I just read a posting on a competing web site (not nearly as good as this one!) saying that unemployed people who apply for naturalisation are required to include with the application a letter from their local benefits office confirming that they are receiving Jobseekers Allowance.

Can this be true? I've looked in every nook of the Home Office web site and see nothing about this.

I'm concerned because I was made redundant but never applied for Jobseekers Allowance.

Perhaps they want such a letter in order to confirm that I shouldn't be making PAYE contributions?

No need to include that JSA stuff - just provide details of current employer etc and they will do their own tax checks!

Hi Chess. Thanks for the reply. The problem is I don't have a current employer. I was made redundant a while ago. But I don't have to worry about JSA?

cant you get a job? or something to show that you have paid taxes etc...

Surely all you should need to prove that you are paying taxes is your national insurance number and your p45 from your last employer? They can do all their checks from that information. And I think as discussed and confirmed elsewhere on this board, being currently employed is not a requirement for naturalisation.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

FromThere2Here, there should not be a problem here. It is not actually a requirement that an applicant for naturalisation is working, or indeed, dependent upon their category, has ever had paid work in the UK.

For example someone getting a 2-year spouse visa, then ILR, and now applying for naturalisation ..... well they might have spent the whole of their time in the UK having and looking after their young children. That circumstance would not preclude them from applying for naturalisation.

Any particular reason why you did not apply for JSA ... after you had your ILR? Was it simply that you were not job seeking?

Ironically, I didn't apply for JSA because I thought it might hurt my naturalisation application!

Do you think I need to explain any of this on my application, or include a copy of my P-45? Or would doing so sound too defensive?

It might hurt a naturalisation application is a claim is made for benefits on the Public Funds list while you had a visa saying "No recourse to Public Funds", but of course an ILR has no such restrictions at all.

So once a person has ILR they can claim benefits to which they are legally entitled.

Enclose the P45? No I don't think so. But I think you should enter the last employer's name and address in the appropriate place on the AN(NEW) form ...... and note that the employment ceased on (date). And enter the tax reference from that P45.

Nothing to stop you claiming JSA now .... assuming that you are job seeking. At the very least that should get your NI contributions credited for the period of claim.
