HSMP Application made before 3rd April 2006 but approved lat

Hi All,

My HSMP application was posted by special delivery on 31st March 2006, fee amount deducted on 4th April 2006 and I received the approval after April 20th 2006.

According to the JR, it says that any applications made before 3rd april 2006 come uder the JR. Can you please clarify what application made means. ??
Is it the date the when the application was posted or the date the fee was deducted

UKBA Policy document para 15.

These migrants gained an initial grant of one year’s leave under the HSMP requirements, or a grant of two years where their application was made before 3 April 2006 but not approved until after this date, and then extended their initial year grant by either three or four years.

By the looks of it I believe you are OK. Since you used the pre-April 2006 form while guaranteed settlement after 4 years. Although your case is on the line, a silly case worker (they have many in HO) may reject it but i am pretty sure you can win the appeal without any problem AND without using any lawyer. Do you have any proof of Postage for 31st of march 2006, although I doubts this.

Thanks for the reply. You are absolutely right about incosistent information from HO.

This is what i found recently

Application date by post
The date of postage is used as the date of application.

The date of an application made by post is decided by the postmark. The payment handling service attaches the original envelope with all postal applications. If the envelope in which the application was posted is missing, or if the postmark is illegible, the date of postage is taken as at least one day before its receipt. The day of receipt is normally the date the payment handling service processed the fee. If there is any uncertainty, you will be given the benefit of the doubt.

I am in the same situation,

Applied on 31 march 2006 successfully for HSMP, chaque got cashed on 10/4/06
ReCEIVED approval letter on 22/4/06

I contacted WPUK sheffield regarding my HSMP application date.
I am told it was 18/04/09 which is completely wrong. According to guidelines they should take the postmark date as the date of application.

Problem is that I lost the postage recepit but has 13 digit reference no which royal mail says they are unable to confirm 3 years down the line as they destroy all record after 1 yrs.

I have been asked by WPUK to write to the to see if they are able to give me my postmark date on my envelope or not?

Any suggestions. what should i do next??

I am in almost similar situation.
I have receipt from HO and it says Application Received on 04/04/06.
So can anyone tell me if i am eligible for PR after 4 years?

Submit SAR. You can ask for your initial HSMP application form - the copy will have the date stamped.

I guess these are called HSMP 1 forms.
These are new applications forms came into effect after 12 April 2005.

So i guess you have filled any of these forms then you will be eligile for ilr after 4 years.

I dont know on which dates in April 2006 new forms came in to affect.

Can you please tell me which "date stamped" will be on fomr? Should I ask any other information from them except form to prove that i made application before 3rd april 2006?
(I have one copy of initial coveing letter from solicitor. He made application by royal mail recorded delivery service and date on the letter is 29/03/2006)
