Tier-2 Change of employment

Post by tejpalv » Tue May 18, 2010 1:39 pm

I am currently on Work permit in a company in UK.
I have got a new job offer & CoS from a UK based employer. The CoS start date is mentioned as 1st June and also this date is mentioned as start date in the Teir-2 application form.

My query is can I still work for my current employer after 1st June if my visa doesn't come before this date?

Its been already 5 weeks and there is no reply from UKBA. Whats the waiting period for Tier-2 now a days?

Changing your job wrote:If you make a 'change of employment' application, we recommend that you do not start your new job until you have received your identity card for foreign nationals. You and your sponsor may agree to start your job before you have your card, on the basis of your approval letter, but you will both carry the risk of having no statutory excuse against a civil penalty if the card is incorrect or withdrawn by us. You can continue working for your previous sponsor until the start date on your new certificate of sponsorship, provided your previous permission to stay has not expired.

Read carefully! Doesn't the text highlighted in blue (above) answer your query?

Thanks sushdmehta for the fats responses.

The thing i want to know is different from the one highlighted in blue.

The blue text says I can work for my current employer till the start date mentioned in the CoS but what I am looking to know is whether I can work even after the start date?

If that were to be possible, UKBA wouldn't have published this restriction.

But that restriction is going to make me jobless now..

as start date on CoS is 1st June and I have not yet got any feedack from UKBA (not even biometric appointment notification)
