Visa Refused......Please help

Hi

I applied on May 3rd for Tier 1 G and i got back my refusal dated 18th May. Here is the reason for my refusal.

I have shown my maintenance fund period from 23-1-10 to 22-4-10. on 23rd Jan, my opening balance in my account was INR 174700. I deposited 50k and my balance became 2,24700. I have maintained the same till date. I made a mistake and thought they will take closing balance for calculating my maintenance fund. So i showed the dates from 23rd jan. Now my case worker has mentioned the reason of my refusal as that my minimum balance on 23rd jan is 174700. so it does not fulfill the 2800 pound eligiblity.

I have received an admin review form too. so please let me know if i can pull through admin review stating that 174700 was my opening balance but i have maintained 2,24000 till date(21-5-10) or should i go for a fresh application? In case of fresh application, how many days should i wait to make a new one?

when did you deposit 50k? in the month of Jan or Feb?
ideally you should be showing your last three months of bank statements starting from 1-Feb till 30-April.

Well according to the rules regarding maintenance you should show last three months of bank statements and should not make any withdraw below the specified amount, I guess in this case you could go for admin review mentioning them to consider your last three months of bank statements starting from 1-feb till 30-April.
But let’s wait for any senior member’s response first and see what they have to say.

am i allowed to submit additional documents during admin review? i am asking because for maintenance, i have submitted bank statements and letter from bank till 23rd april only. but now i have bank statements till 20th may which shows i have been maintaining the amount for more than 90 days.

If your bank statements (submitted initially) show end of day closing balance equivalent of 2800 pounds between 23-Jan and 22-Apr (both days included), then you should submit a request for admin. review.

Calculations are done on end of day closing balance basis only. Read the guidance.

You cannot submit additional documents with AR.

My bank statements show both 1,74700 and 2,24000 for the starting period which is 23rd jan 2010. The amount 2,24000 is also shown on my end date 22-4-2010. In other words, my closing day balance was 2,24000 on both days. But the opening balance on 23rd jan was 174700. so the case worker has considered the minimum balance on my start date. Will my admin review be successful?

Hi

The guidance says

212. Where an applicant is providing evidence of maintenance from a single account, we will always assess the funds available to an applicant from the closing balance given on the document provided.

So they should consider the closing balance. Even if you exclude the date 23-Jan-10, i think the requirement of 90 days was met.

I am sorry....ignore my comment on 90days requirement. If you exclude 23rd Jan, only 89 days were present. But you can go for an admin review i feel

No one can predict "How long it will take". Its all subjective relavent to your specific case.

This is what the ECO officer wrote for refusal

" ICICI bank account number xxxxxx. Bank statement upto 22/4/10. Minimum balance held during 3 months period is Rs.174737(2331 pounds) on 23/1/10. Oanda rate is 0.01331.

Funds required 2800 pounds. Funds presented 2331 pounds

I am not satis fied that you hav provided specified documents to show that you are in possession of sufficient funds as detailed in Appendix C of Immigration Rules. Therefore, I am not satisfied that you hav eachieved 10 points under Appendix C of immigration rules. I therefore refuse your application under paragraph 245C(e) of the immigration Rules."

Tier 1 policy guidance point 212 states they will consider closing balance.

Also UKBA website states the following " If you are applying from outside the United Kingdom, the balance must show that you have had at least £2,800 in your account at all times over the three-month period."

This is really confusing. will they consider Minimum Balance or Closing balance for maintenance funds?

Hi ,

Sorry for the refusal ....

I have read your messages and finally come to conclusion that you made your case well but the 50K deposit turned table for you . IMO , apply for the new application and this time just make this clear in your application / cover letter that 3 months balance is 2800 pound . Again , i am sorry for your refusal.
