non eu student and housing benefit

hi all

I am asking on behalf of someone...

A non EU student can stay in housing benefit flat .

(eg brother is claiming housing benefit and almost all the rent is paid by council and if the international student stays with him in the same flat without paying any rent does the student is also depended on public funds .Does in any way affects his status or application.student is not working completely depended on his brother.

Any answers /information appreciated.
