cyprus visa help

Hi everyone, havent posted for a long time but here goes ...

My husband (albanian with ILR in the UK) went to the cypriot embassy in london yesterday to apply for a visa to visit cyprus on holiday for 1 week in july. He didnt take a copy of our marriage certificate or my passport as wasnt aware that he needed this information. He did however take bank statements, letters from work , travel insurance etc.

I booked the holiday and the flight has both our names on, whereas the hotel accomodation is in my name only as I booked it.

The staff were incredibly rude and unhelpful and were reluctant to handle the case as they did not have our marriage certifcate and his name wasnt on the accomadation. They also said that the £450 in my husbands bank account was not sufficient funds to cover the trip (bearing in mind the trip is half board and has been paid for).

They kept the application and passport, charged a fee, and said to return for collection in 5 days time.

Does anyone know if it sounds as though they will issue the visa based on this? Or will it have no visa stamp when we collect it? I emailed them earlier and they said if I bring my passport and marriage certificate they can refund the money but did not mention whether the visa would be issued?

Sorry for the essay, I hope someone can shed a bit of light in this as Im devestated that I may have to cancel the holiday :-(

what passport do you have ?
If its and EU or EEA or EFTA, then they done you wrong, otherwise I'm sorry but there is little to do

They must issue the visa fast tracked.
As you are an EU Citizen, and both you and your spouse intent to travel togetother.
By EU law, the Visa is FREE of charge. and they may only request both your passports, and marriage cert. Nothing else.

Documents that can be required when applying for the visa

The right of entry of your third country family members is derived
from their family ties with you, a Union citizen. All the Member

applicable. Your family members cannot be asked to present
documents such as travel tickets, employment certificate, pay slips,
bank statements, proof of accommodation and means of subsistence
or a medical certificate.

Yup, as mentioned, the visa should have been issued free of charge and as soon as possible - if applied for correctly.

The onus is on the applicant to apply for a visa as the family member of an EU national and supply both of your passports plus your marriage certificate. He didn't do that.

Thanks for resonses. After reading the information I realise that it is our fault for not providing marriage document or my passport. Hopefully they will still issue the visa as we did provide all other documentation. If they do refuse I guess I can reapply with the correct documents.

Your husband probably does not need a visa for Cyprus at all:

copy of the passport of the E.E.A. or Swiss national.

By "family member residence permit", what is meant is a "Residence card of a family member of a Union citizen". It would help if they used the correct terminology. In any case, I'm afraid charliegal's husband doesn't hold this. He has ILR in the UK.
