10 years long residence set (o) waiting times

Hello everyone!
I had read this forum few times and found it very useful.

I had posted my ilr set (o) application on the basis of 10 years (10 years on student visa) on 10th of Feb 2010 and still waiting.

I have a question to ask from u guys and i need some advice.

In october 2007 i got an extension of 3 years and 3 months to follow a degree. but i didn't do the degree because i had completed a degree before. instead i did a one year advanced diploma followed by the post graduate level 7 dip from edexel (which is higher than the degree)and got the certificate im march.
my current visa is valid until oct 2010. i posted my ilr application in feb2010.
my question is , Do i still need to continue studying? can i work fulltime?

Looking forward to your advices
as long as your ILR application is not decided,you can only work full-time during off-term times( winter/Easter/summer holiday) and only 20hrs per week during academic terms;
refer to your first question whether you can discontinue your current study, a friend called HO got a firm answer 'no,you need to continue your study to be eligible for the student visa status.' furthermore once you quit,your college will report you to the HO (they are obliged to do so under the new immigration codes)

Hope you don't mind me asking but you're 3 weeks away from your 6 month anniversary. Are you planning to complain at that stage?

Yes!! I have every intention of doing so. I don't think its fair to make anyone wait past the 6 month period for a straightforward application. I'm not sure what the complaint procedure is yet but closer to that time, ill start trying to figure it out.

I just hope they count 6 months in terms of weeks, rather than the actual date in the month. In my case for example, Feb 11, March 11, e.t.c e.t.c

I was wondering exact that myself. Weeks or date :?

What's interesting is they don't class delays to applications as a complaint but say you should phone the contact centre. We all know what response that gets us :roll: After 6 months bombard them with weekly phone calls perhaps...

I called the UKBA and they confirmed that 6 months is 24 weeks. So Ill see what happens within the next three weeks. I am going to start writing letters to them because making phone calls is probably a waste of time. Do you know when parliament breaks up for the summer?

Good luck with your application. I am in my week 17 and will request my MP to look into this matter this week.

I personally find that 6 months wait is a ridiculously long period. For a straightforward case, it should really be 3 months then again I am in the positioning of making this change.

I presumed you have spoken to your MP. If so, did you find it helpful? I just have to resort to all possible channels to ensure that they will respond in the 6-month period.

Yes, I do... but only because I did the tour of parliament last summer. I'm not some saddo that knows random info :lol:

It's all of August. They head back to work early Sept.

Lol! Thanks, I will write my MP a letter. I just hope it makes some sort of a difference.

Hi yeezhexiang. No, I haven't spoken to my MP. I thought I'd give the UKBA a chance to prove themselves. They do say within 6 months so, I just thought it would be best to wait until that time frame elapsed before I start pursing other means of chasing the UKBA up.

Hello everyone Im new this forum well not really coz I have been following this tread for the last well five months and must admit that it has been the only thing that has kept me sane. thanks everyone. Just to say I applied on the 18th of December 2009 long residence 10years student and yesterday I heard from my school that the UKBA had written to them requesting my status in the college, they confirmed that I am still studying, so looks like the Home Office is dealing with the December/January applications.

Hie Zeddie, I sent my passport, six months payslips and bank statements, letter from my employer confirming that I work 20hours, letter from my college, I just included my driving licence as well not that I had to but because its clean to support my application and a covering letter and the set(O) form. Hope that helps.

I know this summer wont be easy,but time does flies, do something else to keep yourself busy,so you weren't keep your mind on this all the time,get a job if you r still student,even existing visa expired we can still work,I just recently got a part-time job,so keep myself occupied that I won't think about my PR that often now.

Hie Zara5, thats a million dollar question, its funny coz it seems like you read my mind I was also wondering how long my application would take since the UKBA contacted my school to find out if I was still studying.

@ Zara, if its already with a caseworker (hopefully the caseworker is already dealing with it) then hopefully not much longer as long as it is a straightforward application.

@Cloudstar, someone else on the forum had a similar situation to you where they contacted his college about thim. The UKBA had already made a decision on his application but just wanted to verify that he was still studying. His passport was sent back to him within two weeks of the UKBA enquiring about him. So there is really a good chance that you're application has already been decided or nearly decided. I think you will hear back pretty soon.

Got my ILR today. Issued at Liverpool on 3rd June. 5 weeks for decision and another 5 days postal delay.
