Do you mean she got her entry clearance on Sep 6th 2006 and then arrived here on the 9th, as work permits are 5 yrs from when one gets there entry clearance.wasiter wrote:Hello all,
This is a slightly twisted question about PR.
My wife is in WP and her current WP is expiring by Sep 6th 2011 and she landed in UK on Sep 9th 2006.
Now, is it fair to say that she is missing her PR eligibility by 3 days?
If yes, we will be talking to her employer and ask them to extend it.
OR
Can i ask Homeoffice to consider this situation?
All responses will be much appreciated.
Thanks
This is what i thought as it would be unneccasry to apply for FLR.girlpower19818 wrote:Do you mean she got her entry clearance on Sep 6th 2006 and then arrived here on the 9th, as work permits are 5 yrs from when one gets there entry clearance.wasiter wrote:Hello all,

well, home office states that one can apply for ILR 28 days before leave to remain runs out, which would be 28 days before she got her entry clearance on her passport.
in this case 28 days would be counted as from when she entered the country ( thus 09/10 - 28day should be 12/13 of august). meaning she can apply between 13/08 and 06/09/2011 without any problems and need to extend leave to remain.
hope i am clear and not misleading you.
So, to summarize she can take up the test ( i will ask her to take up the test sometime in July 2011) and her eligibility starts from 12/08/2011 so, we'll try to finish off the process before the 3rd week of august.shrike wrote:You may book an appointment with the UKBA to present the case for same day consideration. She will need to take the "Life in the UK Test"
IMHO she can take the test anytime as this does not have to be witin the 28 day period.
