Points on UK Experience with Earnings > £ 25K Clause - Q

Post by Scherzenando » Mon Jun 14, 2010 12:51 pm

Dear All,

I have doubt on the below UK experience clause for initial Tier 1 applications.

Initial applications

If you are making a switching application or applying from outside the United Kingdom, you can score five points for United Kingdom experience if:

£25,000 or more of your previous earnings that you are claiming points for were earned in the United Kingdom;

I have earnings from India and UK. If I combine both of them (without any uplift) I am getting > £30K and <£35K for which I will get 15 points for previous earnings, now for the additional 5 points will this over all earnings of £30K be considered as UK earnings, or do I need to prove £25K out of the £30K is from UK and rest from India.

Any advise on the same will help.

156. If an applicant has claimed points in the section for previous earnings, and these were for earnings made both in the United Kingdom and outside the United Kingdom, at least £25,000 of the earnings must be United Kingdom earnings to receive the points for UK.

Thank you guys,

Looks like the new rules have really toughned the chances of changing visa category from within UK.
