Second Extension

Hi,

I came to UK on HSMP in Mar 2007 but my visa got stamped in Jan 2007 for 2 years. I got my extension in jan 2009 for three years under tier 1 expiring in Jan 2012.

As per current ILR requirement I need to spend 4 years 11 months in UK but I am short of 1 month for this qualifying period.

Can I apply for the second estension now (two year early before my visa expires) as I can see some probelm in company and i may be got redundant and in future I may not able to qualify for my second extension.

If I can apply for seond extension now then I will be extension for two year or for three year?

You can sure apply now for extension but i think it will be extended for only 2yrs but still u will cover ur 5years by Jun 2012.. having said that you need to be ecnomically active(benificial to the UK economy) with having a job/earnings when you apply for ILR.. just my 2cents..

Hi,
I am in the similar situation of applying 1st extension one year earlier to expiry. but i still have some doubts...
- shall we need to furnish some proof if one applies so early before expiry like any specific reason...
-age is taken from the date of application or at the time of expiry??
-is there any way by which we can extend the visa for some months more which we lost while entering uk since we need to extend just for the some months doing all the stuffs with again fees...

1. Applying early has not limit, you might get or caseworker might return your application. It is solely on caseworker's discretion.

2. Its good if u can supply reason. Otherwise, it should not be a problem in my opinion

3. Age - calculated based on your date of application (extension)

4. I am also looking for this answer.

- "caseworker can return the application" ; but it will be charged so loosing application fees which is hefty more than 800£

similar situation for me as well.
HSMP approved in Se 06 ( so pre Nov 07 scheme)
Applied for EC in Jan 07. migrated to UK in Mar 07.
Applied for FLR and got it extended till Jan 2012. but since I migrated only in Mar 07, I am couple of months short of the 5 year threshold.

while reading the HSMP FORUM LTD JUDICIAL REVIEW policy document, I found out that it states :

“ If an applicant meets these requirements we will grant them:

Three years’ leave; or

Enough leave to enable the applicant to complete the qualifying period for settlement,

whichever is the greater. “


So I believe they should have extended my visa until Mar 2012 and not Jan 2012. can I appeal ? if so can someone tell me the process / contact details pls.
