Hey,

Jdhuphar, my solicitor lodged the appeal and review during last week.
He thought it would be best to do both "just" incase the ECO overturns the decision but if he does not at least we will already be in the appeal process.

I am now at the start of another journey and hopefully will be a short journey. Lucky enough I have been keeping all forms of communication evidences since I left India in March.

I have been told to keep in mind the appeal process takes 1 year so the wait begins.........

ashwanigupta.cfa - My hubby settlement's visa was also refused about 2 weeks ago, we already had a immigration lawyer put together our case due to my husbands immigration history and they automatically deal with the appeal process.
It is best to get your wife to see a immigration lawyer who can advise you both on the best way to handle this. If the refusal points are complicated then its best to get a immigration lawyer to do your appeal. But either way seek advice from one.

Remember you only have 28 days to lodge your appeal.

Idont think my refusal points are complicated. becoz in first point ECO stated that he dont think that offer from her father to provide a house was genuine. and its genuine and i have provided a bank statement of her father which on the address where we will live and also provided my wife's bank statement which is on same address and provided a land registry which is on same address and they dint returned land registry and her father's bank statement. i dont know hw top prove this point. at max her father can go to hearing with her and state that he is ready to provide housing to both of us.

2nd point he stated was that my wife visited india in 2008 and 2010 but in reality according to the passport stamps provided she came to india on indian passport with PR stamp in 2006 (Immigration stamps submitted to BHC) for marrige and went to UK in FEb 2007 (stamps not submitted to BHC) for 1 month and then went to UK in dec 2008 (stamps submitted) for 10 days and then in jan 2009 she went to UK for work and came to visit me and apply my visa in april 2007 on her british passport( stamps submitted) and is with me now. Now the thing is that the stamps provided for 2008 was for visiting UK and immigration officer wrote that she visited india in 2008 and 2010 which is not true. she was living with me till 2009 and visited UK in 2007 and 2008 and left for UK in 2009 and then came back 2010. I think immigration officer dint notice the stamps of 2008 nd he thought its for visiting India whereas it was for visiting UK. dnt knw what additional docs to submit. however I have hired a lawyer in UK bt still I want to make myself assure tht I am submitting enough supporting docs with appeal.

Thats good you have got urself a lawyer, they will advise you on what to do and do it on ur behalf.

If your going to be appealing then you will submit ur additional documents at the hearing only. My lawyer has done review n appeal, he gave all the documents we submitted to BHC Delhi and anything additional will be produced at the hearing.

My refusal was also done on a very stupid point, that we did not submit divorce certificates when we did and he returned them with the bundle but kept my parents and my sponsor letter. So hopefully at the review the ECO will have all the documents we submitted n should overturn the original decision.

I have been told to keep all evidences of communication with my husband since I left India in March and continue till my hearing and also I have been advised is that I need to have a job at the time of my hearing so I have to have payslips and keep my savings up to date etc as all this is going to be needed at the hearing.

Hi Harpz

Hopefully they will review it and overturn. especially if they made the mistake. the Judge wont be happy with them if they take it to court over a minor thing that they should have picked.

ashwanigupta.cfa - sorry to hear the refusal. but you should never give them more info than needed. they have just twisted the info you gave in their favour. you need to ask for a review asap and submit the evidence against their refusal points. also lodge the appeal at the same time.

Hi don't worry about the waiting. it is taking about 12 weeks all over india. you just have to be patient. My wife applied on 13 april and we got and update on firday so you should hear in the next 3 weeks or so

It means that the applicant will be sent for medical tests with a BHC approved doctor. After the medical all being good you should normally get the visa 10-12 days later.

It means that the applicant will be sent for medical tests with a BHC approved doctor. After the medical all being good you should normally get the visa 10-12 days later.

just to update you. my wife had a call from the VFS office today to come and collect the medical letter and docs.
I'll update once she has got the paperwork around 4-5pm IST

Hi guys

as advised earlier my wife picked up the paperwork. She has booked her medical for wednesday. :) she could have done it tomorrow but the medical is in delhi so she has to travel up there (6-7 hour one way journey :shock: ).

also status online has changed to "medical envelope collected on"

Hi mate .. yes my missus collected today as well .... status has changed exactly to what you have written.

Like you she will be going on Wednesday due to the distance to travel.
She has a choice of 2 places where she is able to go for her medical in Delhi, dont know which one they are going to, apparently you just drop in anytime and they do it for you, which is good as previously it was by appointment only.

Finally looks like the waiting is over !!

PS - Did you get all your other docs back that you submitted with your application, because my missus got all mine back, all they have is the original application form and her passport ! .. surely good times.

Yep the same. but my missus had one doctor ticked in green and she called and they advised her to come on wednesday between 9-12. Yep she also got all our paperwork back save for her passport and application

Just to answer anki2003 i think they do a blood test, urine test and xray, and maybe one other test which i can't remember.

looks like delhi is the only place the do medicals.

Hi jdhuphar


Did your wife go for her medical today?

Mine went this morning and apparently all they did was ask a few questions and a chest xray that was all. Fee was 1000 Rupees and was all done within 20 minutes.

Dr said that everything was fine though which is good he said the only thing they look for is TB and just General Health.

Regards to processing time now not to sure how long it will take, he forwards the details back to the BHC Delhi and then just wait for the passports now.

The Dr did say as well they send the results off in Batches so it could be every week they send them off he didnt really give much of an indication to that.

Did they charge 1000rs only for x ray or it is the fee for whole procedure they do. can you pls share what questions they asked to your wife.

my wife's medical was slightly different. she had xray, blood test, BP check, height and weight check. Dr said everything was fine but advised all the visa applicants there to call tmr. I assume they will just confirm the results of the blood tests. Also the Dr asked her for her address and contact numbers in the UK and india.

She said she spoke to the nurse who said that the visa would be issued about a week later. but i have heard i can take up to 10 days.

My wife is back in jalandhar and will call the Dr tmr. I'll let you know what they say.
