Tier 2 Intra Company Transfer as a Contractor

Hi,

I've been a contractor with my company for 12 months now in the U.S. Would I be considered as an "established employee" (based on UKBA terms) and therefore be able to re-locate to the UK with the same company to take up a permanent position there via the Tier 2 Intra Company Transfer? Or, does the term "established employee" only refer to permanent staff?

I hope that's not the case as I also worked on an internship program with the same company for a full year in the UK prior to becoming a contractor in the U.S. branch.

Please advise.

I have a friend with the exact same situation: contractor (as opposed to employee) for around 5 years, to be sponsored as ICT in the UK by the same company. Would it work?
