Just wondering can I request our passports be sent back immediately, after submitting application, quoting our planned travel or should I wait to submit our EEA2 application until we return from holidays i.e end of august.

Hi, so now that you have your RC, you still have troubles when coming back to the UK? The reason I am concerned is because I was once detained for about 5 hours when I came to the UK as a visitor (but at the same time I had a student visa application pending in my home country), I came here for a short trip while I was waiting on my student visa and the IO was not convinced that I was seeking entry as a visitor. he thought since I already enrolled in a college here I would just come in and study without the student visa so after questioning me for 3 hours and made me wait for another 2 hours or so he refused my entry and sent me straight back to my home country. a week later I got my student visa and so I returned here with my visa and was let in no problem.. but since then I have been having problems everytime I re-enter UK. I'm sure you will get back in as you know your rights and can prove that you are a family member.
In addition to the documents you are already going to take, make sure you take evidence that you are living together in the UK too.
This afternoon I made an equiry on the progess of my RC application and the woman told me it's been allocated to a caseworker and that I should return my passport to the Home OFfice soon in order for them to make a decision. I told her I need to travel next week and asked her if I will be allowed back into the country without a FP and she said she didn't see why not, but then it's at the discretion of the immigratiion officers and she also admitted to me that some can be very difficult. arrrggghhh.. i just don't want to have to go through the ordeal that you had been through when u first came to the UK....
I didn't travel until I got my RC as I didn't want the hassle. I never got an FP, just an entry stamp.

My husband is also a degree student. My student Visa is valid till 2012. I guess my case is quite straightforward right? my husband fill in the Section 6 - Your EEA or Swiss National is a student. I appreciate all the information from this forum at the same time was abit worried now coz it seems to be complicated. I am not in a hurry to get a EEA2 as I am studying now and my student visa allowed me to work 20hrs/wk during term time and any hours during holidays. Just that ive to go back to Malaysia in December for my sister's wedding. Hopefully i'll get all my documents back then.
I will keep coming back here to check if there is any new rules or update. Thanks for all the information.

Ive just received all my documents back from the UKBA today. The letter is addressed to my husband, they said as he is a student we must provide comprehensive medical insurance. My husband said we don't need to buy some health insurance coz we both have our NHS medical card and it's stated in the inland revenue that Medical insurance including those that are eligible to NHS services. Hmm..I am not sure about this, everyone here seems to buy a medical insurance just for that but we both have our NHS Medical card that allow us to see a GP anytime we want for free. Anyone could help me with this? do you think we should get a medical insurance? What about we just submit both of our NHS medical card and both of our bank statements that proof that we are financially self-sufficient. Thanks.
Ohh..we also check the guidance notes..under the Residence card they didn't state anything about medical insurance for student..that is only under self-sufficient. This is ridiculous it's like a trick they use to delay the application coz it's not stated clearly. It is for those that apply for residence certificate who are student that need medical insurance. Maybe they just presume we all need medical insurance. We are gonna write a cover letter to state our point when we submit again.

Unfortunately, the UKBA is requesting 'more evidence' altho i have included private medical insurance policy etc. This time they asked why I'm registered at the GP, and why I used NHS for my asthma treatment/ emergency NHS service once before (highlighted on the insurance policy of course - insurance companies are smart enough not to insure what diseases you have had). I also received a letter telling me that I had until mid July to return my passport. * those who follow, I requested my passport back- the email was indeed lost! *thanks for the tip !!! I called, and requested again, and got the MP involved due to the urgency. I got my passport back luckily in time to travel. However they want the passport back within 21 days, which I can't fulfil as it'll be more than 21 days when i get back. I'm bringing the case to the local MP. Two things to discuss: why do I have to explain the reason for using NHS service, and how to extend the 'period' of 21 days by which I have to send back my passport, together with other 'supporting documents to explain why I accessed NHS etc..' How frustrating. Any views on this?? please advise if you can. Thanks!!

So you think I shold just reply to Liverpool office with the a copy of the slip stating the team & case reference ? How long does it take for them to respond to such request you think? i asked because i'll be traveling in 10 days time.. So, there shouldn't be a problem to extend the 21dsay period. You should call and tell them when your passport will be available. And to make sure that they know about it, write to the person who wrote you the letter asking more info and your passport.
About the medical insurance, I don't know anything. I didn't send any medical documents with my application. I guess it's because my husband and I are both working.
One more thing, you can ask questions about the insurance things in the letter to the caseworker. You never know. If this person is helpful enough, s/he may get back to you. Like my case, my caseworker actually called me. Hope that helps.

I also received a letter from UKBA today (dated 28 June) asking me to return ONLY my passport back to them within 21 days (not sure why they didn't ask for my husband's because he's my sponsor...!?) and on monday 28 Jun I also received a call from someone from UKBA (don't think she's the caseworker though) telling me that the only thing missing on my file is my passport so they can't progress on my application and suggested that I return it asap. I told her I need to travel on 7 Jul and at first she said if I want to take a chance and send it on TUes 29 Jun by SD and it'd get there on Wed 30 Jun, and she would put in an urgent request so that they would return it back to me before 7 Jul for me to travel but she couldn't guarantee this would happen. The sooner you send the passport back, the sooner they can finalise your application and send your passport back to you. If they had your passport they wouldn't have needed to request it back from you and you would most likely have your RC and passport by now.
If you send the passport to them special delivery and write a letter stating that you need your passport back by X date for a trip and provide evidence to support it I would think that you would have your passport back in time.
Actually, the caseworker called me this afternoon, he assured that I will receive my documents before my trip if he receives my passport within next week. So, I sent it out today by SD.

Does this mean they're close to issuing me the RC? Usualy when UKBA asks for your passport back how long does it take them to issue the RC after that? DOes anyone know? My timeline is:
application submitted on 27 April
home office received on 28 April
COA received on 18 May (dated 14 May)
requested my passport back on 17 May
received letter from HO asking for passport back 28 Jun
Also when you returned your passport to HO, did you juts send it to the same PO Box address that you sent your application to? In the letter it says an address label was enclosed but nothing was enclosed... and there's a different address on the letter..?
yes I noticed the team and department code so am going to address it to them so that they don't treat this as a brand new application and the package would be sitting in their post room for ages.sanu84 wrote:babie_meg wrote:

The address to return your passport is the same as the one you sent your application. However, there are more information on it like department number, the code for the team and also the case reference number.
