Greetings,

I got my initial HSMP visa on 22-11-2007 and entered the UK on 30-12-2007. Then I extended HSMP / Tier 1 visa last year till 30-11-2012 on a 2+3 years system - yes, the date is slightly different from initial visa 30th Nov not 22nd Nov.

My first question is, can I apply for ILR in 2012 without extending Tier 1 visa?

Second question is about absence - as said above, after entering the UK on 30-12-2007, I had not left until early may 2010 when I started my own company and business (commercial trading between UK and my home country) - I came back home for visiting family and now need to travel for some business trips in my country, which may need me to stay till October 2010.

I understand the whole absence period will go beyond the 90 days period, but as now I am in my home country for both visiting family and making business trips. Will this be allowed if I want to apply for ILR in 2012?

Q1 - To calculate the date you can first apply for ILR add 5 years to the date you first entered then subtract 28 days. If that day is not a normal business day, then you have to wait to the first business day after that.

Looks like you'll miss out by a few days.

Q2 - I suspect you'd be pushing your luck way too far.

Thanks for your reply, do you know anyone who renewed their tier 1 another time for ILR reasons? And how long were they granted on their new visa?

there exist a fixed period and UKBA will extend your visa for another 3 years and normally says whichever is longer...this will give you ample time to apply for ILR for that matter.
