thats correct my lawyer said the same thing , if you apply before autumn the application will be considered under current laws, so my advice is apply before 21 september , as autumn usually starts at that time in the uk. And what if the application is refused and the appeal takes place after autumn? will she then have to take an english test?
I was on the phone with UK immigration yesterday, they were unable to answer most of my questions however they did mention that my US wife would have to take the English test, hope this helps.alanakaja1980 wrote:Does everyone that applies for a visa need to take this test? Thanks jatinderw, and my apologies to alanakaja1980 I hadn't seen that and was clearly given incorrect information from Immigration enquiry bureau on Thursday 2nd Jul 2010. Not the first time I have had incorrect information from immigration though. Certain countries are classified as English speaking therefore will not have to take the test/course .. so lonelyhubband dont know who you were speaking to but clearly stated the US is indluded so your wife won't need to take it.

In answer to your question no she will not need to IF she applied before the new rules.
BUT if she needs to apply again after the rules are introduced, then she WILL have to take the test/course.
