Tier 1 Urgent query

Post by apoc10101 » Fri Jul 09, 2010 6:14 pm

I'm currently on a work permit visa and applying for a transfer to tier 1. Under my work permit scheme I'm allowed supplementary employment subject to a few conditions. I have fulfilled all those requirements and have done some supplementary/part time work.

I was going through my original contract (main employer) and noticed that there is a clause that I need their permission before taking up any other employment. They are currently not aware of my part time work.

Now the dilemma is that I need to include the salary from my part time work in order to qualify for tier 1 (otherwise I'm short of £750) and am concerned about the risk of my main employer finding out about my part time employment.

Can the home office contact my main employer and tell them that I have a second job? What are the chances of that happening? My main employer is a well known company that sponsors numerous employees for work permits/tier 1 visas.

Thanks

I am not sure on this and certainly don't want to give incorrect answer.

As far as I am concerned you should be ok. I don't think they will check with your employer as long as the documents are authentic and covering letter is easy to understand.

however, in the guidelines, they mentioned that if the case worker wants to check the authenticity of the documents, he may call the source of the documents.. this is what slightly worries me.

Just wait to hear from experts in the forum, otherwise just go ahead and do it. anyway you are short of 750 pounds and without mentioning about the part time, you will not meet the requirements. So just go ahead confidently. as they say we will cross the bridge when it comes...

All the best...
