1. If you submit a valid application with required documentary evidence, there is no reason why your application will not be successful.
2. Time spent in UK in a "exempt from immigration" category does not count.

In response to PM from OP:

You cannot make an application for leave to remain as you are currently exempt from immigration control. Any application for leave to remain can be made only after your "diplomatic / official" leave expires, as already communicated to you by UKBA. Only then will your application be considered a "valid" one.

Or you can return to home country and apply for EC as a spouse using a non-diplomatic / official passport.


As already mentioned, time spent in UK in a "exempt from immigration" category cannot be included to meet residential requirements for settlement.

You cannot count time you have spent in the United Kingdom while exempt from immigration control as part of the residential qualifying period. If you are in the United Kingdom as a diplomat or as a member of visiting armed forces or if you are in any place of detention, you would be considered exempt from immigration control. This time would be treated as absence from the United Kingdom.
