need to clarify support for spouse visa help

Hi all

My husband got a job and said he was from an EU country but he was not, he was non eu and an overstayer but nor did his employers ask for his papers, he was paid cash in hand and cheque and he paid taxes to the employer probably the employer pocketed them. I think he may have received a p60 or p45 he never had a NI number. But as supporting docs we want to show that he was working and not taking public funds, he does not wish to incriminate his employers and has a reference from them and can also prove payments into a UK bank account.

now the question is how to show all this for a spouse visa app? can he show the employers letter and blank out contact details? he also has pictures of him working at said place. can he argue that he does not wish to incriminate his previous employers? They did a lot for him. he worked there for 3 1/2 years. He even has a health and safety cert that was sent to another home office dept to register all workers.

hi

Where r u from?? and ur husband??

That means he was working illegally and could be refused the spouse visa under 320(11).
Does he have an insurance number on his name?? how did he in the uk???

im am a british citizen, he is from non EU country he came over on a tourist visa and overstayed that visa, its was his 2nd visa to the UK he did not overstay the first one. he did not have a national insurance number.

I think u need to fix ur relationship first , He told u too many lies,
Anyway , I don t think the OH needs to know he was working (I know a lot of people here won t agree with me) especially if there are no proves (cash in hand),
It is no true the employer was paying taxes on his behalf (Another lie ).

The way u tell the story it souds like he didn t know what was going on.U need to sit with your "husband" and have his story straight before going further. U need to be on the same page . because It is though ahead.

Hope u have evidences of a live together

thanks bbbb but our relationship is fine and a real one. We are currently living in India together adn have been inseperable for longer then a year. He didn't tell me lies, its what he told his employers.

I have clarified with him many points I don't think he has any papers from his ex employers save a reference. But isn't it suspicious to say he didn't work for that period how did he maintain funds? surely he would have to prove it ie bank statements from home country.

He doesn t have to prove anything to the HO,
He could have been living off his saving and when u met him u stated looking after him,
if there are no proves don t mention anything.



if u CAN support him in the UK , he doesn t have to show a bank account or something else.

it is a good thing u have waited for a year to apply for a spouse visa , it increases his chances.
